What a Gurgaon tenancy costs beyond the rent

  • Security deposit — two to three months' rent is normal on an unfurnished society flat, and furnished or premium stock is routinely asked at three to six. There is no statutory cap in Haryana, whatever you may have read; see the note below.

  • TDS under Section 194-IB — if you are an individual or HUF paying more than Rs 50,000 a month, you must deduct tax at 2%. That rate came down from 5% with effect from 1 October 2024. It is deducted once, in the last month of the tenancy or of the financial year, whichever comes first, and paid using Form 26QC. On Gurgaon rents this catches far more tenants than they expect.

The rent rules that are not law in Gurugram

You will see it written that a residential deposit is capped at two months, that a tenancy must be registered with a Rent Authority within 60 days, and that rent can only rise once a year with 90 days' notice. Those are provisions of the Model Tenancy Act, 2021, which is a template the Centre offered the states. Haryana has not adopted it. Gurugram tenancies still run under the Haryana Urban (Control of Rent and Eviction) Act, 1973, plus whatever your agreement says. In practice your contract is the rulebook, so read the deposit, notice, lock-in and escalation clauses properly rather than assuming a statute protects you.
