Tenant Rights and Eviction Rules in India: A Full Guide

Renting a home in India is more regulated than it used to be. The Model Tenancy Act has pushed states toward written, registered agreements and a clear process for disputes. If you are a tenant or a landlord, knowing your rights saves money and stops ugly fights. This guide covers tenant rights, landlord rights, and the legal way to evict.

Quick takeaways

  • The Model Tenancy Act is a framework states can adopt. It pushes for written, registered rent agreements.
  • A landlord cannot force a tenant out, cut utilities, or change locks. Eviction must go through the legal process.
  • Security deposits are usually capped at about two months rent for a home under the Act.
  • A landlord must give proper notice for a rent hike, often three months, and follow the agreement.
  • Valid eviction grounds include non-payment of rent for two or more months, misuse, and refusing to vacate after notice.

What the Model Tenancy Act changed

The Model Tenancy Act was cleared by the Union Cabinet in 2021 as a model for states to adopt or adapt. It applies only in states that adopt it. Others still follow their older Rent Control laws. Where adopted, it brings a few clear rules: agreements must be written and registered, deposits are capped, rent hikes need notice, and disputes go to a dedicated Rent Authority, Rent Court and Rent Tribunal instead of clogging regular courts.

Tenant rights

  • Right to a written agreement. A registered rent agreement protects both sides. See our rent agreement guide.
  • Notice before entry. A landlord must give notice, usually 24 hours, before entering the rented home.
  • Deposit cap. For a residential tenancy under the Act, the deposit is usually limited to about two months rent.
  • Protection from forced eviction. The landlord cannot cut power or water, change locks, or throw you out without a court order.
  • Return of deposit. The deposit must be returned when you vacate, minus lawful deductions.

Landlord rights

  • Timely rent. The tenant must pay rent on time as agreed.
  • Rent revision with notice. Rent can be raised as per the agreement, with proper notice, often three months.
  • Property in good condition. The tenant must not damage or misuse the home or make unauthorised structural changes.
  • Possession back. When the tenancy ends and notice is given, the landlord is entitled to get the property back.
  • Legal eviction. On valid grounds, the landlord can approach the Rent Court for eviction.

Valid grounds for eviction

A landlord cannot evict on a whim. The common lawful grounds are:

  • Non-payment of rent for two or more consecutive months
  • Subletting without permission
  • Using the home for illegal or commercial purposes when it was let for living
  • Causing serious damage or unauthorised structural changes
  • Refusing to vacate after the tenancy ends and proper notice is served
  • The landlord genuinely needs the property for personal use, as allowed by law

The legal eviction process

  1. Serve a written notice stating the ground and giving the tenant time to fix it or vacate.
  2. If the tenant does not comply, file for eviction before the Rent Court or the relevant authority.
  3. Both sides present their case. The court checks the ground and the notice.
  4. If the court orders eviction, it is carried out lawfully. The landlord cannot do it by force.

Self-help eviction, meaning locking out the tenant or removing belongings, is not allowed and can expose the landlord to legal action. Patience and the correct paperwork win these cases.

Practical tips for both sides

  • Always register the agreement. An unregistered paper is weak evidence.
  • Keep records. Save rent receipts, bank transfers and written notices.
  • Do a joint inventory. List the condition and fittings at move-in and move-out.
  • Put deposit terms in writing. State the amount and the deduction rules clearly.

Older Rent Control laws still matter

Not every state has adopted the Model Tenancy Act. In states that still run on old Rent Control laws, some very old tenancies enjoy strong protection and low frozen rents, which is why landlords there are wary of long tenants. This is exactly the problem the new framework tries to fix, by balancing both sides and moving disputes to dedicated rent bodies. If your city still follows the older law, check the specific state rules on notice periods, deposit limits and eviction, because they can differ a lot from the Model Act described here. When in doubt, a short consultation with a local property lawyer is money well spent before you sign or serve any notice.

FAQ

Can a landlord evict a tenant without notice?

No. Eviction needs a valid ground, a written notice, and a court order where the tenant does not comply. Forced eviction, cutting utilities, or changing locks is not allowed.

How much security deposit can a landlord take?

Under the Model Tenancy Act, a residential deposit is usually capped at about two months rent. Older state laws may differ, so check your state rules.

What are valid grounds to evict a tenant?

Common grounds include non-payment of rent for two or more months, subletting without permission, misuse of the property, serious damage, and refusing to vacate after proper notice.

How much notice is needed to increase rent?

Rent can be revised as per the agreement, and the landlord usually must give proper notice, often three months, before a hike takes effect.

Is a registered rent agreement compulsory?

Where the Model Tenancy Act applies, agreements should be written and registered. Even elsewhere, a registered agreement is strongly advised because it protects both tenant and landlord.

Good tenancies run on clear paperwork and mutual respect for the rules. Register the agreement, keep records, and use the legal process for any dispute. That is how both sides stay protected.
