People often confuse NRI and OCI status while buying property in India. Are the rights the same? Mostly yes, but there are a few differences worth knowing. This guide compares NRI and OCI property rights, what both can buy, and where the rules differ.

NRI and OCI: what they mean

An NRI (Non-Resident Indian) is an Indian citizen who lives abroad for work or other reasons. Their Indian passport is still valid. An OCI (Overseas Citizen of India) is a person of Indian origin who has taken a foreign passport but holds an OCI card, which gives lifelong entry and many resident-like rights. So an NRI is still an Indian citizen, while an OCI is a foreign citizen with Indian roots.

Where the difference lies

For property itself, there is almost no difference. The differences between NRI and OCI show up in other areas:

  • Citizenship. An NRI is an Indian citizen. An OCI is a foreign citizen.
  • Voting and government jobs. An NRI can vote and hold certain posts. An OCI cannot.
  • Entry to India. An OCI gets lifelong visa-free entry. An NRI travels on an Indian passport.

None of these change the core property rules, but they matter for planning your overall status.

Funding the purchase

Both NRIs and OCIs must pay for property through proper banking channels. That means using funds from an NRE, NRO or FCNR account, or normal inward remittance. Cash deals are not allowed. Home loans

Both can take home loans from Indian banks to buy residential property. The loan is disbursed and repaid in rupees, usually through the NRE or NRO account. Lenders may ask for a local co-applicant or a PoA holder to manage the paperwork.

Selling and repatriation

Documents both should keep

Whether you are an NRI or OCI, keep the same paperwork ready. This makes buying, selling and repatriation smooth later.

  • Passport, and OCI card if you hold one.
  • PAN card, which is needed for property deals and tax.
  • Proof of overseas address.
  • NRE or NRO account details for payments.
  • A registered Power of Attorney if someone in India will act for you.

Tax is the same too

For income tax, NRIs and OCIs are treated the same way based on residential status, not the card. Rental income is taxable, and capital gains on sale follow the usual rules, with TDS deducted by the buyer. So the tax planning, exemptions and repatriation steps are identical for both.
