What standard rent means

Standard rent is the maximum rent a landlord can lawfully charge for a property covered under a state rent control act. The idea is to protect tenants from being overcharged. Even if the market rent is far higher, a landlord of a rent-controlled property cannot charge more than the standard rent fixed under the law. It is usually based on the cost of the property and a reasonable return, plus allowed additions, rather than the open market rate.

What fair rent means

Fair rent is the reasonable rent fixed by the Rent Controller or court for a property under rent control, taking into account factors like the property's value, its age, the locality and the amenities. In practice, fair rent and standard rent are closely linked. Fair rent is the rent the authority considers fair for that property, and it becomes the standard rent the landlord can charge. Either the landlord or the tenant can apply to have the fair rent fixed.

How they are worked out

The exact method varies by each state's rent control act, but the common factors are:

  • The cost or value of the land and building.
  • A reasonable rate of return on that cost.
  • The age and condition of the property.
  • The locality and the amenities provided.

These give a controlled figure that is often well below the market rent, which is why very old tenancies pay low rents. This links to the low rents seen in the pagdi system.

Why these terms matter

For a rent-controlled property, the landlord cannot charge above the standard or fair rent, and cannot easily raise it. For newer properties rented on an ordinary agreement, market rent applies and these controls usually do not, so rent is set by demand and the agreement.
