The department of town and country planning (DTCP) has stopped the registration of sale, lease and conveyance deeds for a commercial colony in Sector 53 of Gurugram after it found long-pending violations on renewal of licence as well as statutory payments. The department said the development licence in question granted for the project had expired and it was not renewed, hence making all property sales there illegal. egal action against the developers.
DTCP records show that the licence No. 13-19 of 2002 was issued to develop a commercial colony on an area comprising about �3.953 acres�. The licence lapsed in 2005, but the developers did not submit an application seeking renewal despite several impositions under planning rules. The license was issued to Arenas Infotech Pvt. Ltd. and Senior Builders Pvt. Ltd.
The department also found non payment of statutory dues of nearly INR 86.9 lakh and interest thereon as well some other issues related to deductions to be made by producers under various laws due to its deployment during assessment year 2013-14. Such dues relate to license fees, applicable interest and other charges payable under the Haryana Development and Regulation of Urban Areas Act, 1975. According to DTCP officials, failure to make these payments aggravated the violations and stricter enforcement was initiated.
The district town planner (enforcement), Amit Madholia, ordered sub-registrar offices to stall registration of any deeds pertaining to the property. Revenue officials were asked to red entry the land records indicating that the licence has lapsed and violations continued. DTCP also approached the police and sought action but no FIR has been registered against any of the owners or directors of the two companies to date.
According to officials, the action is sought by police for alleged “violations” of licence conditions, bilateral agreements signed with the department and certain clauses of the Act in 1975. The department explained that similar action is being taken in some other cases where commercial or residential licences lapsed, but the constructions continued without such renewals.
DTCP officials said the ban on registration will continue until the developers get their licence status regularized and pay up development charges. Any other actions such as recovery and or prosecution will depend on the outcome of investigations and response from the companies concerned.
