Who Owns the Land Under a Builder Floor?

You do — proportionately. In the standard Gurgaon structure, each floor owner gets an undivided share of the plot along with exclusive possession of their floor. That land share is the reason builder floors hold value over long horizons.

The failure mode is a sale deed that transfers the floor but says nothing meaningful about the land. Have your lawyer confirm the undivided share is stated, and check how the terrace and stilt parking have been allocated. Terrace rights are a recurring dispute between top-floor and ground-floor owners; get it in writing rather than relying on custom.

Builder Quality: What to Inspect Yourself

  • Slab and beam depth. Floor-to-ceiling under 9.5 feet after finishing usually signals a builder economising on structure.
  • Waterproofing on the top floor. Visit after rain if you can, or look for staining at the ceiling-wall junction.
  • Plumbing access. Concealed lines with no shafts mean breaking walls for every repair.
  • Parking reality. Four families, one stilt. Count how many cars actually fit and who has claimed what.
  • Power backup and load. Check the sanctioned load supports ACs in every room, not just a fan-and-light connection.
  • Lift. On a stilt+3 or stilt+4 building, a lift changes both liveability and resale. Confirm who pays for its AMC.

Circle rates were revised from 1 April 2026 and rose steeply in several sectors, so the registry component on the same floor is larger than it was a year ago. Home loan underwriting on a builder floor is genuinely useful diligence you don't pay for. The lender's legal and technical teams check the sanctioned plan, the occupation certificate, the title chain and whether the construction matches approval. If a mainstream bank declines the property — as opposed to declining you — treat that as information, not an obstacle.

Buyers paying fully in cash sometimes skip this and lose the free second opinion. If you're not taking a loan, pay a property lawyer for an independent title opinion instead. On a ₹2 crore purchase, ₹25,000 of legal work is cheap insurance.
